Winter Haven, Florida- 6/28/2022 08:36 PM
On the above date and time, I observed the above listed subject fishing with a rod and reel fishing pole on Lake Shipp, located in Winter Haven, Florida. I observed the subject walk onto CSX property which is posted a no trespassing. The subject observed me walking towards his location and ran further down the Railroad tracks then into the wooded shoreline. After responding to the area, I observed him enter the woods the above listed subject came out of the woods and towards my location. The subject informed me he wasn’t running from me but was checking on a fishing pole. I asked if subject had a fishing license, he informed me he did not.
I asked what his name was so I could conduct an FCIC/NCIC search as well as an in-house search for a freshwater fishing license.
The name he provided was Nashon Sweeny (D.O.B. 7/24/1984). The name he provided did not
return with any information. The subject informed me he had an ID from Pennsylvania, a search of Pennsylvania ID was returned with no information. I Requested another Officer to assist that was equipped with a rapid ID.
Upon hearing this the subject jumped into the water and began swimming away. I instructed the subject to come to the shoreline, he refused. Officer Mitchell instructed him to return to the shoreline, he refused. 3 more FWC Officers arrived on scene to provide assistance. Multiple Deputies as well as Winter Haven Police Officers arrived on scene to provide assistance. 3 vessels were deployed as well as a drone unit. Officers repeatedly instructed the subject to come out of the water, he refused all commands.
All Officers other than FWC Officers left the scene. FWC Officers stationed themselves along the wood line concealed by the vegetation. After approximately 15 minutes I observed the subject wading/swimming towards the shoreline. FWC Officers again went to his location and instructed him to come to stop and come to shore.
The subject again fled and refused to comply with commands. Deputies and Winter Haven Officers again arrived on scene. After several hours of giving verbal commands the subject still refused to obey lawful orders. The subject was spotted with the aid of PCSO Air Units and was subsequently arrested. The subject’s true identity was discovered to be Ashir J. Matai (D.O.B. 6/11/1982). It also discovered Matai had multiple felony warrants from Polk County. Due to the actions of Matai, I was unable to conduct a resource inspection.
