“On April 24, 2024 at approximately 0230 hours, deputies responded to REDACTED, Winter Haven, FL in reference to a shooting investigation. Deputies arrived on scene and located multiple shell casings and live rounds in the roadway. Three strikes were observed on the residence with no injuries reported.
Investigation revealed the two occupants of the residence, REDACTED and REDACTED, were the grandparents of known “4-Savage” gang associate Kelvin Rivera. Neither victim saw anything during the shooting as they were asleep. A total of four .40 caliber “Spear” shell casings and fourteen 9mm Luger casings of various brands (“SIG”, “AUSA”, “WIN”, “Hornady”, “TRN”, “Blazer”) scattered down the street approximately 200 feet north of the incident location. Five live 9mm rounds (two “WIN” and three “Blazer”) and a projectile were also collected among the spent casings. One projectile traveled through the front door and impacted a couch in the living room. One projectile traveled through the front window and struck the ceiling. A projectile was collected within the living room.
Video surveillance showed a dark sedan turning north on to REDACTED from Vaniman Ave. The vehicle continued past the incident location then turned left (west) on to Fern Rd. Approximately 5 minutes later, three suspects were observed walking south on REDACTED. They stopped in front of the incident location and all three began shooting at the incident location. The three suspects then ran north on REDACTED while continuing to shoot haphazardly. Audio was available on the video surveillance and it sounded like one of the firearms was malfunctioning. The suspect continued to fire a round, manually cycle the firearm, and fire again, consistent with several live rounds present among the scattered shell casings.
Additional video surveillance was obtained from the intersection of Jan Phyl Pl and Fern Rd. At 0211 hours, the same suspect vehicle turned the lights off on the vehicle and stopped on Jan Phyl Pl, north of the intersection. Three suspects exited the vehicle and began walking, then jogging towards the direction of the incident location (east). Approximately 4 minutes later, the three suspects ran back to the car and the car fled north on Jan Phyl Pl. Video surveillance showed the suspect vehicle turn left (west) on Recker Hwy at approximately 0215 hours. At the next intersection, REDACTED the suspect vehicle, a 2021 black Chevy Malibu bearing GA tag TEN1702. This vehicle was registered to Dalton Vaquer with an address of REDACTED, Auburndale, FL. The vehicle matched the suspect vehicle observed on surveillance video before and after the shooting. REDACTED captured the suspect vehicle westbound on Hwy 92 past Berkeley Road at 0221 hours then northbound on Berkeley Road from Hwy 92 at 0230 hours.
Detectives at approximately 1045 hours, detectives observed the suspect vehicle parked at his registered address of REDACTED, Auburndale. Contact was made at the residence at approximately 1235 hours. The home owner, REDACTED, confirmed she was Dalton Vaquer’s mother. Detectives learned he has been living in a fifth wheel camper which is parked on the property, next to the residence. Detectives made contact with Vaquer at the camper. He confirmed he owned the suspect vehicle and was driving it around with a friend the previous night. He advised he kept the keys in the trailer, and provided consent to follow him in to see where he kept his keys. He introduced Your Affiant to his dog and ensured Your Affiant was ok with dogs. Vaquer did not immediately locate his keys, and began sifting through some clothing items on the counter next to the doorway. As Your Affiant stood on the steps to the camper, and partially in the doorway, Your Affiant observed a black handgun loose in the clothing items Vaquer was moving. Next to the items was a spent shell casing of comparable size and type to those found at the scene. Amongst the clothing items was a black ski mask. Vaquer additionally made spontaneous statements to detectives that he did have cannabis in the camper.
A search warrant was previously authorized by the Honorable Judge Flynn to search the camper where Vaquer had been living. A Glock 23 .40 caliber handgun, a spent “AUSA” 9mm Luger casing and a Taurus 9mm handgun were located within the residence. Ballistic comparison testing to confirm if either of these firearms were used in the shooting are still pending at this time. The Glock handgun did not have a round in the chamber. The magazine was loaded with 3 rounds (2 “Spear” and 1 “PMC”), when it held a maximum of 13. Video showed three suspects all shooting at the residence. During a search of the camper, the keys to the vehicle were not located.
Vaquer was read his Miranda rights and interviewed in reference to the shooting. He stated he was with a friend in his vehicle during the night time hours. He came home and took a shower in the main residence before returning to his camper. He took a pain pill for his back and fell asleep. He stated the pain pills usually make him sleep really heavily. He was woken up by law enforcement knocking on the door. He had no idea who took his vehicle, but has had issues with “friends” using his vehicle without his knowledge in the past. He has frequently allowed neighborhood “friends” he knows drive the vehicle. Vaquer was unable to name or identify any suspect who may have had the vehicle overnight. Vaquer also stated he has seen several different associates in the neighborhood with the Glock 23 handgun that was found in his camper. He did not know who owned the firearm, and was unsure how the firearm came to be in his camper. He was unsure if it had been in the camper earlier that day.
Video surveillance was obtained from the Circle K located at 1000 Hwy 92 West, Auburndale, Florida, which is positioned on the northwest corner of Hwy 92 and Berkeley Road. At approximately 0221 hours, the suspect vehicle entered the parking lot from Hwy 92 and parked in front of the main doors. A black female with long braids, Raneaqua Rogers, was driving the vehicle, Dalton Vaquer was riding in the front passenger seat, and black male suspects were riding in the rear seats, Daivius Jones and Tay’vaun Williams. All four suspects were wearing all black clothing. The suspects walk around the store and purchase drinks before exiting the store.
The driver of the vehicle was identified as Raneaqua Rogers. Auburndale Police Officer Maldonado has had multiple encounters with Rogers in the Berkley Road area. He is familiar with her from these contacts. Previous law enforcement reports documented an alias for Rogers as “TG Lee” and detail numerous encounters with law enforcement. APD Ofc. Maldonado positively identified Rogers from the Circle K video.
On April 25, 2024, detectives positively identified Daivius Jones B/M 02/03/2007, as the suspect who exited the vehicle on the rear passenger side. D/S McLeod #6865 is assigned to the school resource Gang Resistance Intervention Program. He has had regular contact with Daivius Jones as a part of his assigned duties. D/S Mcleod identified Jones as the suspect in the video.
On April 26, 2024, detectives responded to 403 Walnut St, Auburndale and located Daivius Jones outside his residence. He was detained at the scene. Present with him, was Tay’vaun Williams. Tay’vaun Williams matched the description of the fourth suspect from the rear driver’s side of the vehicle. Daivius Jones was wearing the same black slides from the Circle K video. Tay’vaun Williams was wearing the same black Crocs and same black sweatpants from the Circle K video. Each was read Miranda rights from an agency issued card.
Daivius Jones stated the other night Dalton picked him and Tay’vaun up at his house at REDACTED, Auburndale. They talked outside his house for several minutes. He estimated between 7 to 15 minutes. They drove to the Wendy’s restaurant then to the Circle K to get a drink. They then went home. He identified himself, he identified Tay’vaun Williams, and he identified Dalton Vaquer in the Circle K video. He identified the driver as “TG” who described as his auntie. He stated his cousin, “Twan” was shot at off Berkley Road earlier that night. He said Dalton Vaquer was present at the shooting and had to shoot back at his cousin. Daivius Jones said “they” came for “Twan” because he harmed his child’s mother recently. When he rode with Dalton, he heard a fifth subject “KJ” in the car talking about how he shot at “Kel” who he identified as “Kelvin”. He said Kelvin had been “dissing” his older brother who was shot and killed in the past. Daivius stated it made no sense why the photos showed the direct path to the Circle K when he was picked up from the other side of Auburndale. He denied being present for the shooting.
Tay’vaun Williams stated he was last in Dalton’s vehicle on Sunday or Monday during the day. After observing the photo from the Circle K at 0221 hours on April 24, 2024, he confirmed he was in the vehicle with Dalton and Daivius that night. He stated he was at home when Dalton called and asked if he wanted to run to the store. Dalton picked him up at REDACTED, Auburndale then drove to Daivius Jones’ house at REDACTED, Auburndale and picked him up. They drive to the Circle K then Dalton took him home. He stated he never saw anyone with guns that night and he did not have any. There was no talk about any shooting that occurred. Tay’vaun then stated they drove to a neighborhood down the road, but he was only paying attention to his phone. They parked the car and the other three occupants exited the car and he remained in the rear seat. A few minutes later, he heard several gunshots, but did not think anything of it. The other three occupants then re-entered the vehicle. They left the area then drive to the Circle K.
The suspect vehicle drove down the street, turned the lights off and parked a distance away from the crime scene. All three suspects walked together to the incident location and opened fire on the residence from handguns. All three suspects ran back to the suspect vehicle which was waiting with brake lights activated, as if a driver was still in the vehicle. The vehicle fled the neighborhood at 0215 hours, from Recker Hwy and Jan Phyl Pl. REDACTED identified the suspect vehicle seconds later at Recker Hwy and Hatfield Rd. The suspect vehicle then traveled directly to the Circle K gas station where the suspects exited the vehicle. According to Google Maps, it is an 8 to 10 minute drive from the incident location to Circle K. Tay’vaun admitted to being in the car during the time of the shooting, however the vehicle is placed into gear and stopped waiting while the three shooting suspects are returning to the vehicle. Therefore, his account of being an innocent witness, is inaccurate, as the driver was present in the vehicle, and Tay’vaun was observed clearly exiting the vehicle from the rear door. Tay’vaun must have been an active participant in the shooting. Adding a stop at REDACTED, Auburndale increased the driving time to 14 minutes making it impossible for Daivius Jones’ sequence of events to have occurred.
The vehicle was clearly shifted into drive from park, with brake lights on, while the three other suspects walked towards the incident location. Minutes later, the three suspects ran back to the car, one entered the front passenger seat, 2 others entered on the driver’s side rear door. The vehicle brake lights never turned off during this time. The vehicle then left the area. At the Circle K, approximately 6 minutes later, the vehicle parked and Raneaqua Rogers exited from the driver’s seat. ”
